EXECUTIVE SUMMARY

As snowmobiles have risen in price, credit unions have experienced an increased demand to finance their purchase. However, under Michigan law snowmobiles are not titled making it difficult for credit unions and other financial institutions to perfect a security interest. This could potentially lead to a loss on the vehicle. Currently, snowmobiles are the only untitled motorized recreational vehicle in Michigan.

BACKGROUND

HB 5062 was introduced by State Representative Kevin Green (R-Wyoming) in the fall of 2005 and referred to the House Banking and Financial Institutions Committee.

Despite numerous workgroup meetings on the issue in the last several months, the Michigan Snowmobile Association continues to balk at legislative efforts to include snowmobiles among every other vehicle in Michigan that require title. Governmental Affairs staff continues to advocate for passage of a snowmobile titling bill and sure up support from lawmakers who had committed their support to the passage of HB 5062 while at the same time exploring alternative ideas to secure snowmobile loans.

QUESTIONS

The MCUL staff is requesting feedback from credit unions with respect to the following questions: 

  1. Does your Credit Union file a UCC financing statement with the Secretary of State for snowmobiles that are financed?
  2. Does the credit union pay the associated $15.00 filing fee to the Secretary of State?
  3. If so, does your credit union incorporate the filing fee into the agreement with the borrower?
  4. Can you share any credit union stories associated with snowmobile financing (i.e. problems with repossession, theft, or default) that Governmental Affairs staff can convey to law makers?
